Anyway, I don't think she ever saw the agent coming from the passenger side. When she realized that she was going to be arrested, she panicked and tried to haul ass..In doing so she went towards the agent coming around the front. They can use lethal force at that point and have no need to try to determine what the drivers intentions are.
This sorta reminds me of the tourists who have their friends take video of them standing near bison in Yellowstone.

I reckon the ICE agents were thoroughly pissed off with being belittled by strident women, her wife certainly was goading them, and had probably been doing so for hours.
The wheels spinning on the ice as she first reverses and then revs up complicate matters. I don't think anyone can know for sure if she intended to run over the officer, but in any case he was a fool to stand directly in front of the vehicle
He shot at her the moment she was turning the wheel, had he not shot, she would have driven the vehicle to the right...which is where it careered after he had fired.
I think he endangered his and others lives more by shooting to kill, a dead driver with a foot clamped down on the accelerator could go in any direction.

I guess that's it then, and he'll be exonerated. I suppose if you look at the original footage from an unbiased perspective, and ask yourself 'does it look like she was trying to run him over', the answer will be 'no'. But if he claims he thought she was, then it looks like he gets away with it.
